Short-Term Rental Agreement

Cloud 9 Vacation Rental

In lieu of signatures, a reservation deposit made by guest acknowledges review and acceptance of this entire Short-Term Rental Agreement. All guests staying at or visiting the property are jointly and severally liable under this Agreement.

 

1. Minimum Age Requirement: Guest must be at least 25 years of age.

 

2.Availability: In the unlikely event circumstances beyond our control prevent us from providing the exact property you request we may (a.) cancel the reservation and refund all monies paid, or (b.) transfer your reservation to a comparable or superior unit managed by Cloud 9 Vacation Rentals. Our maximum liability for damages incurred due to the unavailability of the reserved property shall be limited to the total amount of fees paid.

 

3. Payments: If payment of the total amount due is not received prior to arrival this reservation will be canceled. All payments become the property of Cloud 9 Vacation Rentals. You hereby authorize the booking agent, or Cloud 9 Vacation Rentals, to charge the credit card used to secure the reservation for any additional monies due under this Agreement.

 

4. Cancellation Policy: Cancellations made 5 or more days before arrival will receive a full refund. If local activities/resorts/venues/amenities (like pools & hot tubs) have canceled or closed, this is beyond our control and will not provide an exception to our Cancellation Policy. Neither will illness, weather, snow conditions, road closures or canceled flights be just cause for a refund beyond this policy. Upon check-in, you are responsible for all nights reserved.

 

5. Travel Insurance: Cloud 9 Vacation Rentals strongly encourages you to purchase travel insurance. Cloud 9 Vacation Rentals does not offer insurance currently. Viable insurance options can be found via a web search.

 

6. Occupancy: Exceeding the occupancy advertised for this property will result in a $500 fine, eviction, or both.

 

7. House Rules, Laws and Regulations: You agree to comply with all statutes, ordinances and requirements of all local, state and federal authorities. No parties, events, loud music, or smoking (of any kind) are allowed inside the premises or outside on patios/decks. A $500.00 fine and/or eviction with no refund may immediately result from violations to any said laws, rules and regulations. No pets are allowed at any time. If legal action is necessary, you agree to be responsible for all legal fees for both yourself, members of your party and Cloud 9 Vacation Rentals.

 

8. Parking: You will be provided with parking instructions and must obey any parking rules set by the governing body of the property where you are staying. Failure to display a pass if required, and follow said guidelines, may result in your car being towed at your expense.

 

9. Check-In Time: 4 pm MST. Due to cleaning time and inspecting of the unit after cleaned, there is no early check-in.

 

10. Check-Out Time: 10 am MST. It is important you honor check-out times as housekeeping has a tight schedule to prepare for the next guest. Failure to depart on time will incur an additional charge of $80 for each hour you hold over or be subject to an eviction with the rental amount due for a full day stay.

 

11. Damages: You are responsible for any damage or unreasonable wear and tear to the vacation rental unit, including all contents, that occur during your stay. Please notify us of any existing damage to the unit immediately upon arrival to avoid liability. No waxing of skis or snowboards is allowed in the premises! Damages or missing items will be charged to your credit card.

 

12.Lost Items: Cloud 9 Vacation Rentals is not responsible for lost, stolen or misplaced money or personal property of any kind. If an item is left behind, please contact us. If found, Cloud 9 Vacation Rentals will gladly return the item for the cost of postage plus a $50 surcharge. Lost keys to the rental unit or clubhouse keys/keycards (if applicable) are subject to a $100 replacement fee.

 

13. Departure Procedures: A simple list of departure procedures will be provided and must be completed to avoid additional charges (i.e., all doors and windows locked, the dishwasher started, trash removed, used towels placed in the shower/tub, etc.). You may be charged $50.00/ hr. to correct any undone items or if you leave the condo or linens dirtier than is normal or reasonable.

 

14. Start-Up Supplies: Cloud 9 Vacation Rentals provides the initial supplies and linens to get started (toilet paper, soaps, towels etc.). We do not restock or replenish during your stay.

 

15.Entry and Inspection: Cloud 9 Vacation Rentals, its contractors and agents, shall have the right to enter the property at any time in case of emergency, or to make repairs as necessary. If your unit has a lockbox, you must leave the key in the lockbox at all times to facilitate entry.

 

16.Assumed Risk: This property is in a high alpine environment and is subject to low oxygen, heavy snow, freezing, and slippery conditions. Use of the property, as well as hot tubs, swimming pools, or other amenities, are at your own risk. As with most properties in the mountains, this unit does not have air conditioning.

 

17. Activities/Actions of Neighbors/Township: Cloud 9 Vacation Rentals has no control over possible construction activities or any actions of neighbors or township workers which may impact your stay. Cloud 9 Vacation Rentals will notify you at the time of booking, or prior to your arrival, of any possible issues that Cloud 9 Vacation Rentals becomes aware of. Beyond that, Cloud 9 Vacation Rentals cannot make any representations or warranties as to anything else which may occur.

 

18. Indemnification and Waiver: You agree to hold harmless, Cloud 9 Vacation Rentals and the property owner(s), (“Released Parties”), from any and all liability for costs, expenses, claims, disputes, litigation, judgments, and attorney fees resulting from loss, damage, or injury to you, your party, invitees or licensees, or their personal property, arising out of the occupancy or use of the property, except for injury or damage caused by the gross negligence of the aforementioned Released Parties. This waiver is intended to be a full and complete waiver and release of the Released Parties from any and all present and future claims.

 

19. Insurance: You acknowledge that the property owner's, or Cloud 9 Vacation Rental’s, insurance does not cover you, your party, invitees, or licensees personal property, including vehicles, against loss or damage due to; fire, theft, vandalism, rain, snow, water, criminal or negligent acts of others, or any other cause.

 

20. Attorney Fees: In any action or proceeding involving a dispute arising out of this Agreement, the prevailing party will be entitled to reasonable attorney fees and costs incurred in enforcing this Agreement.

 

21. Entire Agreement: The foregoing constitutes the entire agreement between the Parties.

 

22. Notices: All notices to be delivered under this Agreement may be delivered via email.
